DECLARATION OF COMPLIANCE AND RELEASE ("Release")

 

• I hereby declare that I am a selected entrant (the "Entrant") in the Sweepstakes.  I understand that I will be awarded the following prize:

• $10.00 Summersalt® gift card for entrants who cause five or more friends to enter the Sweepstakes.
• $20.00 Summersalt® gift card, Best Babes t-shirt and tote bag valued at $30.00 for entrants who cause 25 or more friends to enter the Sweepstakes, and
• One Summersalt® swimsuit valued at $95.00 for entrants who cause more than 50 or more friends to enter the Sweepstakes.

 

The “Grand Prize”:

 

• The “Grand Prize”:  Hotel accommodations for two for two nights in Morocco, valued at up to $500.00 a $2,000 stipend toward travel, two Summersalt® swimsuits valued at $190.00 ; two necklaces from the Summersalt®/AUrate collection valued at $200, and one Summersalt® Turkish towel valued at $50.00 for a total approximate retail value of $2,940.00.

 

(each, a "Prize"), if I complete and submit this Release and Declaration of Compliance as instructed below and otherwise comply with the Official Sweepstakes Rules ("Official Rules"), and that at that point I will be a winner ("Winner").

 

In consideration of Summersalt, Inc., AURATE, INC. d/b/a AUrate New York, and Bumble Trading, Inc. d/b/a Bumble BFF (collectively the “Sponsor”) awarding the Prize to me, I hereby: 

1. acknowledge that I have read, have complied, and will comply with all the rules, regulations, terms and conditions set forth in the Official Rules (incorporated herein by reference); that I have not perpetrated and will not perpetrate any fraud or deception in connection with the Sweepstakes and have not sought to influence the outcome of the Sweepstakes other than by participating as expressly permitted in the Official Rules;

2. acknowledge that the Prize is as described in the Official Rules;

3. agree to be responsible for all federal, state, and local taxes associated with Prize acceptance;

4. release, indemnify and hold harmless Sponsor; its parents, subsidiaries, affiliates, and advertising and promotion agencies; the employees, officers, directors, representatives, agents and attorneys of each of the foregoing; and the heirs, executors, administrators, personal representatives, successors and assigns of the foregoing (if any) (collectively, "Sponsor’s Representatives") from any claims, demands, payments, actions, or causes of action for damages, loss or injury, arising as a result of my participating in the Sweepstakes and accepting the Prize, which I or my heirs, executors, administrations, personal representatives or assigns may now or hereafter have against them;

5. grant Sponsor and any of Sponsor's clients or designees the right to use my name, city of residence and any image taken of me by or on behalf of Sponsor, in connection with the Sweepstakes, in any and all media now or hereafter devised without limitation and without additional compensation, notification or permission or other liability to me or my heirs, executors, administrators, personal representatives or assigns;

 I declare that:

1. I am a legal resident of either the eligible 49 United States or District of Columbia

2. I am not a resident of the State of Rhode Island

3. I am not a resident of Puerto Rico

4. I was at least 18 years of age at the time of entry

5. Neither I, nor anyone with whom I live (whether or not related) or any of my immediate family members (spouse, parent, child, sibling or their respective spouses, regardless of where they reside) is an employee, officer, director, representative of Sponsor or any of its parents, subsidiaries, affiliates or advertising and promotion agencies; and

6. The terms of the Official Sweepstakes Rules and this Release shall apply to and be binding on me and my heirs, executors, administrations, personal representatives and assigns;

7. warrant and represent that I have full right and power to enter into this Release, and that the terms of this document do not in any way conflict with any existing commitment on my part;

8. agree that this Release supersedes any prior understandings between Sponsor and me relating to the rights granted herein and no provision of this Release can be modified by any other instrument, invoice or document unless in writing and signed by the parties hereto;

9. acknowledge this is a complete RELEASE and DISCHARGE of all claims and rights I may have against the Sponsor’s Representatives, and that no action will be taken by or on behalf of the undersigned with respect to any such rights; it being understood that this release shall be binding upon the parents, guardians, heirs, executors, and administrators of the undersigned;

10. understand that if any statement made by me in this Release is false or if I am otherwise deemed ineligible or unable to accept the Prize for any reason, then, in addition any other remedies that may be taken against me, I agree to return to Sponsor the Prize.

11. have been given a full opportunity to review and analyze this Release as well as the promotions in the Official Sweepstakes Rules for this Sweepstakes. I fully and completely understand all of the terms of this Release and sign it voluntarily, freely, and knowingly.

THIS DECLARATION OF COMPLIANCE AND RELEASE IS SPECIFIC TO THE NAMED SWEEPSTAKES AND PRIZE IDENTIFIED IN THIS DOCUMENT AND TO THE WINNER IDENTIFIED ABOVE WHO SIGNED THIS DOCUMENT.  THIS PRIZE DID NOT REQUIRE ANY PURCHASE BY WINNER FROM SPONSOR OR OTHERWISE.  WINNER IS RESPONSIBLE FOR ANY TAXES ON THE PRIZE.
