1. Eligibility

The Best Babes™ Morocco Getaway Sweepstakes (hereinafter the “Sweepstakes”) is only open to legal residents of 49 United States and the District of Columbia who are at least 18 years old at the time of entry. Residents of the Rhode Island and Puerto Rico are prohibited from entering this Sweepstakes.  Employees of Sponsor and other companies associated with the promotion of the Sweepstakes, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.  The Sweepstakes is subject to federal, state, and local laws and regulations.  Void where prohibited.  The winner agrees that the Sponsor, its affiliates and its agents and employees shall not be liable for injury, loss or damage of any kind resulting from participating in this promotion or from the acceptance or use of any prize awarded.  Sponsor reserves the right to verify eligibility qualifications of any winner. 

 

2. Sponsor

The Sweepstakes is sponsored by Summersalt, Inc. (“Summersalt”), located at 911 Washington Ave., St. Louis, Missouri, 63101, www.summersalt.com; AURATE, INC. d/b/a AUrate New York, located at 958 Madison Avenue, New York, New York 10021, https://auratenewyork.com/ (“AUrate”) and Bumble Trading, Inc. d/b/a Bumble BFF https://bumble.com/bff (“Bumble BFF”).  Summersalt, AUrate and BFF shall each and collectively be referred to as the “Sponsor” of this Sweepstakes.

 

3. Agreement to Official Rules

Participation in the Sweepstakes constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Sweepstakes Rules (“Official Rules”) and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

 

4. Sweepstakes Period

The Sweepstakes begins on October 10, 2018 at 5:00 a.m. E.T. and ends on October 31, 2018 at 11:59 p.m. E.T. (the “Sweepstakes Period”). Entries that are submitted before or after the Sweepstakes Period will be disqualified.  Submissions will be accepted for the duration of the Sweepstakes at the online site and via mail, as provided below.

 

5. How to Enter

Through the Bumble BFF App:  This method of entry will be available by downloading the Bumble BFF app, switching to “BFF mode”, and following the instructions in the Bumble BFF app.  Participants that enter through the Bumble BFF app will automatically receive a second bonus entry in the Sweepstakes.

 

Online: This method of entry will be available by visiting bestbabes.summersalt.com/aurate-bumblebff and following the directions or by following the instructions received through e-mails, each Sponsor’s website, each Sponsor’s Facebook page, and each Sponsor’s Instagram page.

 

Via the Unique URL:  Each entrant will receive a unique URL that can be shared to promote the Sweepstakes to the entrants’ friends and family.  When an entrant’s friend or family member enters the Sweepstakes by clicking through the unique URL, the entrant who generated the unique URL will automatically be entered into the Sweepstakes again for another chance to win. 

 

Via US Mail: This method of entry will be available for the entire Sweepstakes Period.  On a 3x5 card, handprint your full name, complete address, phone number (including area code) date of birth and e-mail address, and mail the 3x5 card, in an envelope with proper postage affixed to:  911 Washington Ave., St. Louis, Missouri 63101, Attention:  Sweepstakes Entry.  Mail-in entries must be hand-printed and mailed in separately. All mail-in entries must be received by October 31, 2018. 

 

For each entry for a chance to win, an entrant will complete and submit the form where the entrant is asked to provide certain information, including the entrant’s name and email address.  Each entrant who enters electronically will receive a unique URL that can be shared to promote the Sweepstakes to the entrants’ friends and family.  When an entrant’s friend or family member enters the Sweepstakes by clicking through the unique URL, the original entrant who generated the unique URL will automatically receive a second, bonus entry into the Sweepstakes for another chance to win.  Limit one initial entry per person, per customer, per e-mail address, and per household for the duration of the Sweepstakes Period.  Bonus entries are only given after one official entry has been made into the Sweepstakes via the entry methods described above. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void.  All entries become the property of Sponsor and will not be acknowledged or returned.

 

6. Conditions of Entry 

Eligible entrants must enter via one or more of the online methods or US mail method as described.  Incomplete entries are void.  Any entry by a resident of Rhode Island or Puerto Rico is void.  By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements.  The Sponsor is not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any Web site or online service, or any other error or malfunction, or late, lost, postage due, illegible or misdirected entries.  Entry materials that have been tampered with or altered are void.  No copies, facsimiles or reproductions of official entry forms will be accepted.  You are solely responsible at your sole cost and expense for creating backup copies and replacing any content you post or submit through Sponsor’s Facebook page.  You agree that under no circumstances will Sponsor be liable in any way for any loss or damage to any content you post, e-mail, or otherwise make available to Sponsor. 

 

7. Prize Drawings

On or before November 12, 2018 (but in no event before October 31, 2018), the Sponsor will select the potential winner in a random drawing from among all eligible entries received by 11:59p.m. E.T. on October 31, 2018.  Only the Grand Prize winner will be selected in a random drawing from among all eligible entries received.  Throughout the Sweepstakes Period, entrants can win the Runner Up Prizes by achieving entry milestones described in Section 9 of these Official Rules and Runner Up Prizes are awarded based on the number of new friends and family members who enter the Sweepstakes through such entrant’s unique URL. The odds of being selected as the Grand Prize winner depend on the number of entries received. The Sponsor will attempt to notify the potential Grand Prize winner via e-mail during the week of November 12, 2018.  If the potential Grand Prize winner cannot be contacted within one day after the date of the first attempt to contact him or her, the Sponsor may select an alternate potential Grand Prize winner in his/her place at random from the remaining non-winning, eligible entries.

 

8. Grand Prize Winner Notification & Prize Delivery

The potential Grand Prize winner will be notified by e-mail.  The potential winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, sign and submit a Declaration of Compliance.  The Declaration of Compliance will be e-mailed to the potential winner after contact within five business days after the time of notice or attempted notice is sent, in order to claim his or her prize by either (a) e-mail to squad@summersalt.com or (b) via US mail to Summersalt, Inc., 911 Washington Ave., St. Louis, Missouri 63101, Attention: Prize Claim Department.  If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period, or the prize is returned as undeliverable, the potential winner forfeits the prize. If the potential winner is at least 18 but still considered a minor in his or her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his or her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winner’s behalf and fulfill any other requirements imposed on winner set forth herein.  Potential winners must continue to comply with all terms and conditions of these Official Sweepstakes Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three alternate drawings will be held, after which the prize will remain un-awarded.  The Grand Prize will be awarded after the conclusion of the Sweepstakes and after the receipt of the potential winner’s Declaration of Compliance, and be delivered via either United States Postal Service ground mail, UPS, or FedEx, as determined by Sponsor.

 

8. Runner Up Winner Notification

The Sponsor will attempt to notify the potential winners of the Runner-Up Prizes via e-mail (through the e-mail and at the phone number submitted by the potential winner to enter the Sweepstakes) throughout the Sweepstakes Period and during the week of November 12, 2018 after the number of entrants caused by one entrant are tallied and a potential winner is identified at the end of the Sweepstakes Period.  If the potential winners cannot be contacted within one day after the date of the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his or her place from the remaining non-winning, eligible entries. Only three alternate drawings will be held, after which the prize will remain un-awarded.  Only one Runner Up Prize will be awarded to a single entrant. The Runner Up Prizes will be awarded after the conclusion of the Sweepstakes Period within three weeks after the Sponsor’s receipt of the potential winner’s Declaration of Compliance, via either United States Postal Service ground mail, UPS, or FedEx, in each case as determined by Sponsor. 

 

9. Potential Prizes

One of the following prizes will be awarded to each of the potential winners after review and tabulation of the number of entries caused by another entrant:

 

The “Runner Up Prizes”:

• $10.00 Summersalt® gift card for entrants who cause five or more friends to enter the Sweepstakes.
• $20.00 Summersalt® gift card, Best Babes t-shirt and tote bag valued at $30.00 for entrants who cause 25 or more friends to enter the Sweepstakes, and
• One Summersalt® swimsuit valued at $95.00 for entrants who cause more than 50 or more friends to enter the Sweepstakes.

 

The “Grand Prize”:

• Hotel accommodations for two for two nights in Morocco, valued at up to $500.00 a $2,000 stipend toward travel, two Summersalt® swimsuits valued at $190.00 ; two necklaces from the Summersalt®/AUrate collection valued at $200, and one Summersalt® Turkish towel valued at $50.00 for a total approximate retail value of $2,940.00.

 

Tickets for air travel, train, bus, or other travel to reach the hotel destination in Morocco, travel fees or charges, gratuities, onboard incidentals, food, drinks, and activities are not included and are the responsibility of the passenger(s). This offer is not exchangeable against other events tickets, travel or hotels; offer is not combinable with any other promotions and/or discounts; nontransferable and has no cash value.  Cash, gift cards, travelers' checks or similar cash equivalents will not be awarded. The winner may travel with one travel companion or alone. Multiple travel companions during prize trip are not permitted. Travel must be completed on or before October 31, 2019, or the winner forfeits all rights to the Grand Prize.  The Grand Prize winner and the winner’s travel companion are solely responsible for obtaining the proper travel documentation (e.g., valid photo ID and/or passport) prior to travel.  The winner’s travel companion will also be required to sign the Declaration of Compliance prior to travel being booked. If the winner or travel companion is a minor, as determined by the laws of the state in which s/he resides ("minor"), then the Declaration of Compliance must be signed by the minor's parent or legal guardian and the minor winner or travel companion must be accompanied by his or her parent or legal guardian. The winner and the winner’s travel companion must travel on same dates and same itinerary. Arrangements for the fulfillment of the prize will be made by Sponsor and/or its designated agent.

 

Any taxes on prizes won will be the sole responsibility of the winner.  No substitution or transfer of prizes is permitted unless an item is not available or delivery is not possible (for any reason or no reason) to the address of the potential winner.  Sponsor shall be entitled to substitute the item with a comparable replacement product with the same or better features.  Sponsor has no affiliation with the companies that have prizes included in the prize bundle except as such prizes are incorporated into the prize package by the Sponsor. 

 

10. General Conditions

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Sweepstakes is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.  The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.  Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees and costs) and any other remedies from any such person to the fullest extent.  Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

 

11. Release and Limitations of Liability

By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, and each of its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, sweepstakes judges or entrant counters, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Sweepstakes-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant be entitled to receive attorneys’ fees or other related costs. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

12. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Missouri.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Missouri, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Missouri.

 

13.  Use of Entrant Information by Sponsor

By entry into this Sweepstakes, each Entrant consents to the use of the Entrant’s name, identity, photograph, and any photo or video submission (if applicable) for promotional purposes, including online announcements, without additional compensation, except where prohibited by law, even if such Entrant’s submission is not selected as a winning submission for this Sweepstakes.  If the Sweepstakes is terminated prior to the end of the stated entry period, notice will be posted at bestbabes.summersalt.com/aurate-bumblebff, through e-mails, and on each Sponsor’s website, each Sponsor’s Facebook page, and each Sponsor’s Instagram page.  Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by Sponsor and/or its agents. To request the name of the winner send a self-addressed stamped envelope to 911 Washington Ave., St. Louis, Missouri 63101.  Winner List requests will only be accepted after the promotion end date (stated above).  For the Winner List, you can also send an e-mail.  Requests received after one month past notification date will not be honored.

 

14. Privacy Notice   

Entrants should read the “Privacy Policy” for each of Summersalt, AUrate and Bumble, located at the following “Privacy Policy” links: https://www.summersalt.com/pages/privacy-policy; https://auratenewyork.com/pages/privacy-policy, and https://bumble.com/en-us/privacy.  By entering this Sweepstakes, entrants may receive marketing materials, communications and other materials from one or more of the Sponsors and affiliated or other companies whose products and services the Sponsors feel might interest entrants at a future date.  An entrant not interested in receiving this material, should send an email to hello@summersalt.com to notify Sponsor of entrant’s desire not to receive such materials.
